FDA Establishes CDER Exclusivity Board to Standardize NCE and Biologic Exclusivity Rulings
CDER's new Exclusivity Board will oversee NCE, new clinical trial, and biologic exclusivity determinations to improve consistency across rulings.

Regulatory affairs directors with pending or future exclusivity claims now have a new internal FDA body to account for: CDER has established an Exclusivity Board designed to impose greater consistency across exclusivity determinations, with direct implications for NCE, new clinical trial, and biologic product pipelines.
The Board's mandate covers 5-year new chemical entity (NCE) exclusivity, 3-year new clinical investigation exclusivity, and exclusivity for biological products. Its role is advisory and selective, it will not review every determination in these categories, but will intervene on contested or complex matters, including specific requests where existing policy leaves room for inconsistent interpretation.
Notably, the Board's scope excludes routine review of 180-day generic drug exclusivity, 7-year orphan drug exclusivity, and 6-month pediatric exclusivity. For those categories, the Board will maintain communication with the relevant FDA groups rather than assume direct oversight. This delineation matters for regulatory teams managing multi-exclusivity portfolios: the locus of decision-making authority differs depending on exclusivity type, and routing a query to the wrong channel could delay resolution.
Beyond individual determinations, the Board is also empowered to evaluate and recommend changes to CDER's broader exclusivity policies and practices, and will maintain records of its determinations. That record-keeping function suggests the Board intends to build a documented precedent base, a development that could, over time, reduce interpretive variability across review divisions. Regulatory affairs leads should monitor published outputs from the Board as that record accumulates.
Inquiries on exclusivity matters can be directed to [email protected]. Teams with active exclusivity questions tied to NDA or BLA submissions should assess whether their specific circumstances fall within the Board's review criteria before routing correspondence.
The first measurable indicator of the Board's practical impact will be whether exclusivity determination timelines for NCEs and biologics shift relative to pre-Board baselines.
