FDA Reissues Tropical Disease Priority Review Voucher Guidance
FDA reissues guidance on tropical disease priority review vouchers under FDAAA section 524, clarifying eligibility and award criteria for sponsors.

Priority review vouchers tied to neglected tropical disease approvals remain one of the more transferable regulatory assets a sponsor can hold, and FDA's reissued guidance under docket FDA-2008-D-0530 clarifies how the agency interprets the eligibility and award criteria established by section 524 of the FD&C Act (21 U.S.C. 360n). For regulatory affairs leads managing pipelines that touch neglected disease indications, the document is the operative reference for voucher qualification strategy.
The guidance implements section 1102 of the Food and Drug Administration Amendments Act of 2007 (FDAAA), which created the tropical disease priority review voucher program. Under that statutory framework, sponsors who receive approval for a qualifying tropical disease product application become eligible for a voucher that can accelerate a separate, unrelated application through priority review, or be transferred or sold to another sponsor. FDA issued this guidance in direct response to recurring industry inquiries about the scope of section 524 and how specific provisions should be interpreted in practice.
Regulatory teams should note the agency's standard caveat: guidance documents do not establish legally enforceable responsibilities and reflect FDA's current thinking rather than binding requirements. Where the word "should" appears, it signals a recommendation, not a mandate, unless a specific statutory or regulatory citation accompanies it. That distinction carries weight when building a voucher eligibility argument or responding to agency questions during application review.
Comments on the guidance remain open on a rolling basis under 21 CFR 10.115(g)(5), submitted either through the FDA electronic docket portal or in writing to Dockets Management, 5630 Fishers Lane, Rm 1061, Rockville, MD 20852, referencing docket number FDA-2008-D-0530. Sponsors with active tropical disease programs who have unresolved interpretive questions about eligibility criteria have a direct channel to shape agency thinking through that comment process.
The guidance is jointly issued by the Center for Biologics Evaluation and Research (CBER) and the Center for Drug Evaluation and Research (CDER), reflecting the voucher program's applicability across both biological and small-molecule product classes, a scope that broadens the strategic relevance for sponsors across multiple modalities.
For companies with qualifying tropical disease assets in late-stage development, confirming alignment with section 524 eligibility criteria before submission remains the most direct path to preserving voucher optionality at approval.
